1. Use of Services

You agree to use our Services only for lawful purposes and in accordance with these Terms. You must not use our Services in a way that infringes the rights of, restricts, or inhibits anyone else's use of the Services.

2. Services and Payment

Outset Digital provides website design and development services, primarily for Australian tradespeople and local service businesses. Specific project scope, deliverables, timelines, and pricing will be set out in a separate quote, proposal, or agreement provided to the client before work begins.

• Payment terms (deposits, milestones, final payment) will be confirmed in writing for each project.

• Unless otherwise agreed in writing, ownership of the final website transfers to the client upon payment in full.

• Any revisions outside the agreed scope may incur additional charges, to be discussed with the client beforehand.
  
  

3. Intellectual Property

All content on our Site, including logos, text, graphics, and software, is owned by Outset Digital or our licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or modify any content without our permission.

Pre-existing tools, frameworks, templates, or code libraries used in the course of delivering a project remain the property of Outset Digital or the relevant third party, unless otherwise agreed in writing.

4. User Content

If you submit any content to us (e.g., comments, reviews, testimonials, or material provided for use in your project), you grant us a non-exclusive, royalty-free license to use, display, and distribute that content in connection with our Services. You are responsible for ensuring that your content does not violate any laws or third-party rights.

5. Limitation of Liability

To the extent permitted by law, Outset Digital is not liable for any direct, indirect, incidental, or consequential damages arising from your use of our Services. We do not guarantee uninterrupted or error-free operation of the Site or any website we build or maintain.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

6. Termination

We reserve the right to suspend or terminate your access to our Services at our discretion, without prior notice, if you violate these Terms. For active client projects, termination arrangements (including any fees owed for work completed) will be handled as set out in the relevant project agreement.

7. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes arising from these Terms or our Services will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.

8. Changes to Terms

We may update these Terms at any time. Your continued use of the Services after changes are posted constitutes your acceptance of the new Terms.
